Policy leaves new mom jobless

Topeka resident Jane Anabe says she was fired by Policy Studies Inc. for "job abandonment" in February when she didn't return to work a week after having a Caesarean section to deliver her son.

Anabe said she continued to work until Feb. 3 and had her son, Isaac, by C-section on Feb. 4. She was released from the hospital on Feb. 7, and on Feb. 9 sent an e-mail to Sherrod saying her doctor had ordered her not to return to work for six weeks because of the surgery. She provided a copy of the doctor's note.

"I would very much like to return to work, but since I am physically unable to do so at this time, I hereby request an extension of leave until March 18, 2010," she wrote.

"Furthermore," she added, "since company policies and procedure were not laid out when I agreed to work for the company, I do not see any need to resign from my position."

Three days later, Anabe received an e-mail from Maylee Winter, HCM analyst/leave administrator with PSI, reiterating that she wasn't eligible for leave because she hadn't been employed with the company for at least 90 days.
